Florida recognizes four main types of alimony.
(1) Bridge-the-Gap
(2) Rehabilitative
(3) Durational
(4) Permanent
These types of alimony differ in whether they are modifiable and if so in what ways. However, as a Jacksonville Family Law Lawyer, I usually run into cases where Former Husbands want to reduce the monthly permanent alimony payments they pay their Former Wives. These Former Husbands want to know if they qualify to have their payments reduced and or terminated
The answer always depends on each indivdual’s circumstances, but for the most part modifying permanent alimony in Jacksonville can be done. Most often alimony payments can be decreased if the following three factors are met.
(1) Whether there has been a substantial change in circumstances since the final judgment was entered which granted the alimony obligation.
(2) The change was not contemplated at the time of entering the final judgment.
(3) The change is sufficient, material, involuntary and permanent in nature.
Keep in mind this is a very brief synopsis on the issue of modifying alimony. To learn more or to schedule a free consultation contact a Jacksonville Family Law Lawyer today.
